This Players Clearinghouse Privacy Policy (“Privacy Policy”) discloses the practices of The Players Clearinghouse, Inc. (“Players Clearinghouse,” “PCH,” “we,” “our” or “us”) concerning information we obtain by and through your access to and/or use of: (a) the Players Clearinghouse platform (“Platform”); (b) the website located at https://playersclearinghouse.com (the “Site”); (c) the Players Clearinghouse mobile application (the “App”); (d) the content, functionality and services offered by or through the Platform or the Site (collectively, the “Content”); (e) Players Clearinghouse social media pages/accounts on third party social media websites, such as Facebook®, Instagram®, Twitter® and YouTube® (collectively, “Social Media Pages”); and (f) any of our other services or products.  The Platform, Site, App, Content, Social Media Pages and any of our other services and products are collectively referred to herein as the “Services.”

Players Clearinghouse is committed to respecting your privacy and recognizing your need for appropriate protection and management of personally identifiable information that you share with us. The purpose of this Privacy Policy is to explain: (i) the types of information Players Clearinghouse obtains about visitors to our Site, users of our App and users of our other Services; (ii) how the information is obtained; (iii) how it is used; (iv) the choices you have regarding our use of; and (iv) your ability to review and correct, the information. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you do not have permission to access and/or use the Services. By registering with us or submitting personal data through our Services, you expressly consent to the collection, use and disclosure of your personal data in accordance with this Privacy Policy. We will process your personal data in accordance with applicable data protection and privacy laws. When you register with us, you are required to consent to our Privacy Policy. This consent provides us with a legal basis under applicable law to process your personal data. You maintain the right to withdraw such consent at any time.

The Players Clearinghouse Platform may be used and accessed by sports organizers who use Players Clearinghouse software to interact with sports registrants and/or by the sports registrants themselves. The term “sports registrants” refers to Players Clearinghouse member account holders who are either: (i) participants (“players”) in sports leagues/organizations and are eighteen (18) years of age or older; or (ii) the parents or legal guardians of Sports Participants under eighteen (18) years of age. As such, certain features of the Services may be offered to users directly by Players Clearinghouse, or through one or more third party league organizers who offer a white label or private-label version of the Services to their respective sports registrants.

This Privacy Policy describes how Players Clearinghouse collects, manages, and uses information collected through the Services but your use of and access to the Services may also be governed by additional policies or agreements entered into directly between sports registrants and organizers. Players Clearinghouse is not responsible for the practices of third parties that Players Clearinghouse does not own or control or individuals that Players Clearinghouse does not employ or manage. However, sports organizers agree to provide their respective sports registrants with at least the same level of protection as that provided to users by Players Clearinghouse by and through this Privacy Policy. If you have any questions about whether any third party sports organizer policies or agreements apply to your use of the Site, App and/or Services, please contact the applicable sports organizer.

A. Information you provide us

Member Account Information: When you create a “Member Account” you may be asked to provide the following information: name, email address, phone number, organization name, role in organization, number of players in your organization, organization website and zip code. If you subscribe to paid features or functions of the Services, we may also collect billing information from you.

Sports Organizers Information: Through your use of our Services, we may also ask you to provide statistics, demographic information, and/or other information relating to your sports organization or your organization’s sports registrants. We collect this information to allow you to use more of the features and functions related to our Services, including scheduling, event management and tracking tools. You should not submit any information regarding your organization or its sports registrants that you are not fully authorized to submit with the informed consent of the applicable sports registrants in each instance.We may receive your information from third parties that provide services for us in connection with the Sites and Services, and Players Clearinghouse may connect this information to your information that we already have.

Beyond the minimum information required to use the Services, we store data that you provide us for the Services. Examples include:

  • Your contact information (e.g., phone number, physical address, etc.)
  • Sports specific information (e.g., position, sports statistics, etc.)
  • Schedule information (e.g., whether you plan to attend an upcoming event)
  • Location information (e.g., your physical location at a given time)
  • Device and software information (e.g., the type of mobile device and associated hardware and software information, the browser used to access our web service, etc.)

Like many online services, we use cookies to collect information. “Our Site uses or may use “cookies” to gather non-personally identifiable information. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. To find out more about cookies, please visit www.cookiecentral.com.  Generally, we use cookies to store information about your preferences and activity during and after your visit to a website. Most browsers automatically accept cookies, but you can usually refuse cookies, or selectively accept certain cookies, by adjusting the preferences in your browser. If you turn off cookies, though, there may be some features of the Services that will not be available to you and some Site pages may not display properly. By using the Site and/or Services, you consent to Players Clearinghouse’s use of cookies.

Neither Players Clearinghouse, nor any third parties, place cookies or other tracking technology on the Site or in the App that tracks user activities after they leave the Site and/or exit the App, as applicable. Therefore, the Site and App do not respond to Do Not Track (DNT) signals.

B. Information about how you use the site

We track how users use our Sites and Services including what pages they visit and what actions they take. Players Clearinghouse automatically receives and records information from your web browser when you interact with the Services and/or the Site, including your IP address and cookie information. This information may be used for service functionality, to help us understand how users access a website, to fight spam/malware, to facilitate the collection of data concerning your interaction with the Services or the Site and for other similar purposes.

C. Information about your device or network

We track what types of devices you use to access our Sites and Services. We collect device attributes like operating system, screen size, browser, etc.

We also track what networks you come from including your mobile operator, ISP, and location. For security purposes we also track device specific information such as your IP address and device specific identifiers such as IDFA.

D. Payment information

If you choose to purchase any of our paid services, you will need to pay using a payment card (e.g., credit or debit card). We use a third party integrated payment processor to process payments in connection with the Sites and Services. This payment processor has committed to Players Clearinghouse to process your payment card information in a secure, PCI compliant manner. Your payment card information is processed and retained by these third parties and will not be passed on to Players Clearinghouse; Players Clearinghouse does not store your payment card information.

If you are a sports organizer, you also may use Players Clearinghouse to collect funds from other users. We may deduct a service fee from these fund transfers, but we will always spell out any applicable fees at the time of the transaction. In addition, we will not use payment information you have provided for fund transfers to charge you for other services. The fund transfers do not flow through Players Clearinghouse and are accomplished using an integrated payment processor, which is subject to separate terms with that third party (please review the section of this policy entitled “How We Share Your Information” below for more information).

E. Information from third parties

We receive data from third parties that are associated with Players Clearinghouse. These third parties provide us with data that you are using their service. In addition these third parties may provide us with information about services you may be interested in. For example, they may provide us with what sport you are associated with or what type of coaching you do.

A. Provide, measure and improve services for you

Our primary use of your information is to deliver our Sites and Services for you to use.

We also use your information to measure and improve our Services. We look at this data in anonymous and aggregate form to determine things like how many users in total are using a given feature.

We also access information from third parties that provide analytical data. Our primary analytical service is Google Analytics. We use that information to improve the effectiveness of Players Clearinghouse and make the service easier to use. We analyze the data in the aggregate, rolling up the data across many users to better understand how Players Clearinghouse is being used at a macro level. During the process of developing, troubleshooting and administering the Site and Services, it may be necessary to look at pieces of your information to improve the Services and user experience, offer you additional information, opportunities and functionality, respond to requests that you make, resolve a problem or dispute, investigate potential security issues, or verify your compliance with our terms of use. Also, when you write us to request support, our customer support representatives may look at your information in order to assist you. We may also access and use your information to compare information for accuracy and verify it with third parties or to comply with applicable law or legal process.

B. Communicate with you

We use your information to send you marketing communications, communicate with you about our Sites and Services and let you know about our policies and terms. We also use your information to respond to you when you contact us.

Data you share through the Sites and Services

The Sites and Services offer a number of ways to share content with members of your team, club or your sports organization. You make the determination what data you want to share and how you want to share it. For example, as a player or parent you can decide what data to enter on the roster and in some cases you can enter that data but make it private. Team owners can enable the ability for the team to share certain information to social media sites and sports organization owners can determine if they want a website that is publicly accessible. In all cases the data shared is driven by the users.

B. Vendors and service providers

Players Clearinghouse may use other companies to perform services, as further described below. These third parties operate components of the Players Clearinghouse architecture. Players Clearinghouse also relies on these third parties to maintain the safety and security of your information.

We may share your information with third-party service providers to: provide you with the Sites and Services that we offer you; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to Players Clearinghouse or to you.

C. Third party apps and sites

Players Clearinghouse works with various third parties to bring you additional goods and services through our Sites and Services (e.g., league scheduling solutions, game and team statistics solutions, marketplace solutions such as apparel sales). We may share your information and transaction data (excluding payment card numbers) with such third parties if you, your team manager, your club director, or your event organizer has indicated interest in such third parties’ goods or services. Such third parties may also collect your information from you if you decide to interact with them. If we redirect you to a third-party site, we may send you to a URL on the third-party site which indicates some category data about you. We do not pass personal information to such third-party sites without your permission. However, that third party may add that category data to the data it stores about you. Please review that third party’s privacy policy to understand how it uses such data.

Information shared with or collected by such third parties is subject to their privacy policy. We do not control the privacy policies of these third parties and we encourage you to review their privacy policies.

D. Special Circumstances

We also may disclose your information, including personally identifiable information, in the following circumstances:

  1. In response to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law;
  2. When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Site/App terms and conditions or other agreements or policies.
  3. In connection with a corporate transaction, such as the sale of all or a portion of our business, a divestiture, merger, consolidation, or asset sale, or in the event of bankruptcy. We will endeavor to contact you in the event of any of these transactions, but we do not promise to do so.

Managing and deleting your information

If you are a registered user, you may review, update, correct or delete your information by logging into the Players Clearinghouse App and editing your Account Details. If you are unclear about how to do this or have concerns, contact us at support@playersclearinghouse.com. Registered users who are California residents can find additional information about your rights below.

If you wish to exercise any of these rights, please contact us using the details below. In your request, please make clear: (i) what personal data is concerned; and (ii) which of the rights you would like to enforce. For your protection, we may only implement requests with respect to the personal data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable and in any event, within one month of your request. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.

Opt-out. You may contact us anytime to opt-out of: (i) direct marketing communications; (ii) automated decision-making and/or profiling; (iii) our collection of sensitive personal data; (iv) any new processing of your personal data that we may carry out beyond the original purpose; or (v) the transfer of your personal data outside the EEA. Please note that your use of some of the Services may be ineffective upon opt-out. Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our Terms of Use or Privacy Policy.

Access. You may access the information we hold about you at any time via your account, where applicable, or by contacting us directly at support@playersclearinghouse.com.

Amend. You can also contact us to update or correct any inaccuracies in your information.

Move. Your personal data is portable – i.e. you to have the flexibility to move your information to other service providers as you wish.

Erase and forget. In certain situations, for example when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your information, by contacting us at support@playersclearinghouse.com. We retain the right to retain your information for up to 60 days after we process your deletion request.

Please be advised that deleting your personal information may terminate your access to certain of the Services.  If you wish to continue using the full complement of Services, you may not be able to delete all of the personal information that we have on file for you. Please be further advised that, after you delete your personal information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

Photos, team schedules and other information may be maintained by the team, club directors, or event organizers. If you have concerns about that information, please contact them directly.

We may communicate with you at various times, with administrative emails or phone calls, about transactions and service announcements, customer service responses and promotional emails like special offers, newsletters and updates. You can choose to stop receiving promotional emails at any time simply by changing your preferences, unsubscribing through the applicable Sites and Services, or using an email's unsubscribe function. You may not opt out of receiving administrative messages or customer service responses, unless you delete your Players Clearinghouse account. If you have agreed to receive marketing communications through interactions with our partners, you must change your communication preferences with them directly.

A. Data retention and security

The security of your information is important to us. We store your information in Players Clearinghouse’s systems and we use reasonable security precautions to protect it. No method of electronic transmission or storage is 100% secure, however. Therefore, we cannot guarantee the security of your information or other information. If you have any questions or concerns about security, email us at privacy@playersclearinghouse.com and we will do our best to respond to them.

We retain information as long as it is necessary and relevant for our operations. Typically we retain information submitted for a sports registrant, team, club or event organizer until it is deleted by the user or club director/group owner/manager so that it may be accessed on an ongoing basis (for example, for historical reference or for the next season). In addition, we may retain your information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service and take other actions permitted by law.

B. Privacy for individuals under 18

Please see our Information for California Residents section below for details regarding our use and sharing of the personal information of minors.

The Site, App and Services are not directed at, and should not be used by, individuals under 13 years of age, and we do not knowingly collect personal information from individuals under 18 years of age absent the permission of a parent or legal guardian as set forth below. If you are 13 years of age or older, but younger than 18 years of age, you can only submit information by and through the Site, App and/or Services with the permission of a parent or legal guardian, after that parent or legal guardian has reviewed this Privacy Policy in its entirety. If you are under 13 years of age, you are not permitted to provide any information by and through the Site, App and/or Services (including any information about yourself, such as your name, address, telephone number, e-mail address or any screen name or user name that you may use). Only parents or legal guardians may create an account for sports registrants under 13 years of age. Players Clearinghouse does not solicit or collect personal information from individuals under 13 years of age. If we learn we have collected or received personal information from an individual under 13 years of age, we will delete that information and any related account. By registering for the Site and/or Services, users represent and warrant that they are over 13 years of age.

C. International transfer

Our Site, App and Services are hosted in the United States of America and are subject to applicable U.S. Federal and state laws, rules and regulations. Your personal data, may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in your country. By using our Services, you consent and agree to this transfer, storing, processing and use of your personal data in accordance with this Privacy Policy.

D. Sensitive information

Subject to the following paragraph, we ask that you not send us, and you not disclose, any sensitive information (e.g., government identifiers, information related to racial or ethnic origin, political opinions, religion or other beliefs, biometrics or genetic characteristics or trade union membership) on or through the Services or otherwise to us. Note that clubs or sports organizers using our Services may request certain health information from you to help ensure the safety of players. We do not use that health data in any of our marketing or advertising activities. Please consult the club or sports organizer to understand how they use, disclose, and process such data.

E. Complaints

We are committed to resolving any complaints about our collection or use of your personal data. If you would like to make a complaint regarding this Privacy Policy or our practices in relation to your personal data, please email us at privacy@playersclearinghouse.com. We will reply to your complaint as soon as we can and in any event, within 45 days. We hope to resolve any complaint brought to our attention, however if you feel that your complaint has not been adequately resolved, you reserve the right to contact your local data protection supervisory authority.

F. Changes

If we decide to change this Privacy Policy, we will post the changes on this site, and if there is a material change to our Privacy Policy for any reason, we will notify you promptly by sending an email to an email address we have on file for you.

G. Do not track

Our Site and App do not currently respond to Do Not Track (DNT) signals from web browsers.

H. Your Nevada privacy rights

Under California Civil Code section 1798.83, California residents are entitled to ask us for a notice identifying the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to us via email at privacy@playersclearinghouse.com. You must put the statement "Your California Privacy Rights" in your request and include your name, street address, city, state, and ZIP code. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

Deletion. To request that we delete personal data about you that we have collected from you.

Nondiscrimination. To exercise your rights described above free from discrimination, such as denial of goods or services; price/rate increases for goods or services (including through grants of discounts/benefits or imposing penalties); decreases in service quality; or suggesting that such discriminatory acts may occur if you exercise your rights. However, a difference in price or service quality is not discriminatory if reasonably related to the value to our business of the personal information we are unable to use due to the exercise of your rights, and we may offer you certain financial incentives that can result in different prices, rates or service quality.

Financial incentive program disclosures. To receive a clear description of the material terms of any program involving financial incentives for the collection, sale or deletion of your personal information, and decide if you want to consent to be entered in it (you can revoke this consent at any time).

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child under 13 years of age.

The verifiable request must: (i) provide sufficient information that allows us to reasonably verify you are a California resident about whom we collected personal information or their authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

These rights are not absolute, are subject to exceptions, and we may be required or permitted by law to decline your request.
